THE SMALL SECOND HOME BASICS:
Latest Update May 2024 The latest National Construction Code (NCC) came into effect for Victoria on 1 May 2024.
NOW houses built after 1 May require a 7-Star energy rating. This will also affect any kits, container homes and imports !
So let us arrange a permit first THEN BUY !
Some of the key features of a small second home still include:
- Floor area equal to or less than 60 square meters
- Sited on the same lot as an existing dwelling
- One small second dwelling per lot, however there may be more than one and this would be subject to a planning permit
- Is self-contained, i.e. has a kitchen, bathroom, toilet and laundry facilities
- No carparking required
- Anyone can live in it or rent it out
- Cannot be subdivided from the primary dwelling
- Cannot be connected to reticulated gas
- Meets siting requirements, including minimum garden area
- Can be attached, detached or a conversion
- Must have an access path from the front street.
- There will be no restrictions on how a small second home can be used – they can be used flexibly(business or other non residential uses may require permit).
- Small second homes will still require a building permit, will need to meet ResCode (residential design code) setback and siting requirements.
In many cases there are no issues.
In some cases, work can be done to meet the guidelines.
In most cases, a small second dwelling will not require a planning permit; however, a building permit is always required.

WARNING IF YOU OPERATE A BUSINESS
If a person rents their small second dwelling for short term accommodation of the Airbnb or Stayz type on an irregular or intermittent basis, such rental may fairly be regarded as ancillary to ‘self-contained residence’ use of the building. So if the second small dwelling is “rented out for additional income” and that renting out is ancillary to the actual substantial real purpose of the small second dwelling (being a building used as a self-contained residence) there is no complaint about the idea that small second dwellings can be rented out.
BUT YOU MUST consider where the small second dwelling is used solely or primarily to provide short term accommodation for people away from their normal place of residence and not being used by a resident of the dwelling to provide such accommodation, such as is the case with bed and breakfast. Operating without a permit is illegal and may void insurance ! SO ASK US TO INVESTIGATE FIRST BEFORE OPERATING, BUILDING OR ADVERTISING !
